Recently, the European Union has adopted and published a set of Directives and Regulations containing new rules and obligations applicable to online intermediaries offering services across the whole European single market (including, but not limited, to online platforms).
In the field of taxation, under Directive 2021/514 (“DAC7”), digital platforms, such as Wallapop, which allows users to sell goods to other users, have been required to report certain information about those users and their economic activities to the tax authorities. Therefore, starting from 1 January 2023, Wallapop is being obliged to gather, assess, and report information with the tax authorities about certain sellers that use our platform.

In the field of e-commerce and digital transformation, under Regulation (EU) 2022/2065 (“DSA”), digital platforms, such as Wallapop, which allows consumers to conclude distance contracts with traders, have been required, among other obligations, to ensure the traceability of those traders. Therefore, starting from 17 February 2024, Wallapop is being obliged to gather and assess certain essential information and documentation about all the traders that use our platform.
